1) Introduction
1.1The agreement is made between kenthouseads.co.uk (we/us/our) and the advertiser (you/your). By entering into the agreement you are confirming you have read the Terms and Conditions listed below and agree to abide by them.

1.2 You agree to us publishing your advert details on the World Wide Web via our website, any of our business partners and in local press as we see fit.

1.3 You have the right to cancel this agreement within 24 hours of inception and receive a full refund. No refunds will be considered or offered following the expiration of the 24th hour.

1.4 Clause 8(3) of The Consumer Protection (Distance Selling) Regulations 2000 states that the statutory cancellation (cooling-off) period of 7 days for services purchased over the internet, does not apply where performance of that service has already commenced with the customer's agreement. Our online payment facilities are designed to activate your public advertising automatically and therefore, by making a payment for advertising on this site you signify your agreement to the advertising service commencing IMMEDIATELY and that the standard cooling-off period does not apply as per clause 8(3) of the Regulations. This does not affect your right to cancel your advertising within 24 hours for a full refund (see above).

1.5 We will advertise your property until sold, with the unlimited option or for a period of one calendar month with the monthly option. (Subject to a Home Information Pack being in place, as required by the Housing Act 2004)

1.5.1 To enable the site to remain up to date, the advertiser will be required to contact us on, or within 14 days of each six month anniversary of the advert being added to the site, to state they require the advert to continue. The advert will then be renewed with no further charge. 

1.6 We will restrict our financial liability and exposure by:

1.6.1 The fee we charge covers the set up cost of each property listing on our website and the cost of administration.

1.6.2 Once the property details have been live on our website for a period exceeding 7 days, our service is deemed to have been completed.

1.6.3 After this 7 day period has expired, further advertising and support is provided free of charge until sold or the month expires, depending on the option chosen.
1.7 If an Estate Agent is used alongside kenthouseads.co.uk we do not hold any responsibility for any fees charged by such an agent, we strongly advise you inform any agent you are advertising your property elsewhere. In our opinion we do not carry out any 'Estate Agent' duties (as defined by the Office of Fair Trading) therefore using kenthouseads.co.uk will not effect a sole agency agreement. 

2) Our Responsibilities

2.1 We shall to the best of our efforts, ensure that our website is available at all times we do, however, reserve the right to take the site off line without prior notice for maintenance.

2.2 If selected, we shall supply a For Sale board, this will display your contact telephone number if required

2.3 We reserve the right to edit or delete any descriptions which we know or believe to be false or misleading to comply with the provisions of the Property Misdescriptions Act 1991. Your property description should only provide a factual breakdown of the property features - it should not include false information about your property or terms of sale which are not a matter of fact or which cannot be ascertained and verified by reasonable inspection.

2.4 The prices shown on this website are what you pay. There are no hidden costs. We reserve the right to amend or change pricing or package service content at any time without notice.

2.5 Our website is hosted in a secure protected environment with excellent security, fire and backup measures in place and a very high level of service is anticipated.

2.6 We cannot guarantee our advertising partners services. Advertising with these partners is provided with no cost to you and may be withdrawn without prior notice. 

3) Property Particulars Disclaimer
3.1 We would like to stress that all property particulars are made without any responsibility of kenthouseads.co.uk and are made by the vendors themselves. Any potential purchaser must satisfy themselves that all the details are correct on any of the statements contained within the property particulars.

4) Your Responsibilities
4.1 By advertising with us you agree that you have the legal right to sell the property advertised.

4.1.1 By uploading your property to kenthouseads.co.uk you are agreeing you have a Home Information Pack in place or you have comissioned one or you do not need one.

4.2 The description that you supply is a true and accurate representation of the property. That the description is not misleading, kenthouseads.co.uk wish to emphasize that they do not take any responsibility for the accuracy of the information supplied and cannot be held liable. Provide contact details to us stating if you want these to appear in the advert.

4.3 You will pay the full advert fee before the advert is uplifted onto the website.

4.4 You will set your own selling price.

4.5 You will arrange and conduct the viewings of the advertised property.

4.6 You provide up to 6 digital photographs of your property.

4.7 You inform kenthouseads.co.uk once the advertised property is sold.

4.8 If you are with an Estate Agent, prior to submitting your property for inclusion on our website we recommend that you check any contract held with them; kenthouseads.co.uk hold no responsibility with regards the particulars of any individual arrangements you may have with an existing agent.

5) User Conditions

5.1 You may print hard copies of property adverts for your own personal non-commercial use.

5.2 All other forms of copying are prohibited, except with our express permission.

5.3 It is your responsibility to verify any information that you may obtain from our site with  independent authorities prior to acting upon them.

6) Changes to Terms & Conditions

6.1 We reserve the right to change these terms and conditions without prior warning to you. If we change the terms and conditions it will be posted to our website and become effective at the time of posting.

7) Complaints
7.1 If you experience any problem using our service, or we make an error in publication, let us know straight away and we will do everything in our power to put things straight.
